CYBER CRIMES AND THEIR PUNISHMENT IN UAE
Cybercrime is criminal activity that either targets or uses a computer, a computer network or a networked device. Most cybercrime is committed by cybercriminals or hackers who want to make money. There are two types of cybercrime; social engineering attack Vs phishing. In a social engineering attack, an attacker uses human interaction (social skills) to obtain or compromise information about an organization or its computer systems. An attacker may seem unassuming and respectable, possibly claiming to be a new employee, repair person, or researcher and even offer credentials to support that identity. However, by asking questions, he or she may be able to piece together enough information to infiltrate an organization's network. If an attacker is not able to gather enough information from one source, he or she may contact another source within the same organization and rely on the information from the first source to add to his or her credibility. In phishing attacks, email or malicious websites are used to solicit personal information by posing as a trustworthy organization. For example, an attacker may send an email seemingly from a reputable credit card company or financial institution that requests account information, often suggesting that there is a problem. Phishing constitutes a crime under the UAE cybercrime law with penalties applied against such criminals. Unlawful access into information systems of state institutions is criminalized according to Article 3 of the UAE Federal decree As per Article 3, a temporary prison term and a fine ranging from a minimum of AED 200, 000 and a maximum of AED 500, 000 shall be applied to anyone who unlawfully accesses a website, electronic information system, information network or any information technology means that belong to state institutions”. Similarly hacking is also yet another activity to exploit a computer system or such equipment by unauthorized access or control over it for some illicit purpose. Article 2 to 5 of the UAE law punishes any person who enters without the permission on an electronic site, information system, and remains in it illegally for any kind of unlawful gain. Basic penalty is fine up to 300,000 dirhams and the penalty can increase if any damage or deletion of any data up to 7, 50,000 dirhams. Cyber Crime is a dangerous offense to someone’s privacy or material. It is a violation of not only law but of human rights too. What seems impeccable and indestructible today might not remain the same tomorrow. The internet, being a global phenomenon, is bound to attract many crimes. One must be careful enough to protect one’s actions without leading to any kind of cybercrime.
